Frequently asked questions

What is a 609 letter and how does it work?

609 are what you need to get negative accounts taken off your credit report. You can use it to dispute errors, resolve inaccuracies, and handle other items that might be impacting and lowering your credit score. The 609 letter is based on rights granted under Section 609 of the Fair Credit Reporting Act. Under Section 609, credit reporting agencies are required to disclose certain information to consumers who request it. Section 609 of the FCRA requires credit bureaus to remove negative information that is outdated and/or cannot be verified. Consumers have the right to an accurate credit report. That means that only accurate, complete, and verifiable information can be included in your credit report. This is not a quick process and multiple letters may have to be sent. Stay persistent.

What is Debt Validation?

Collection Agencies must be able to verify, or "validate," any debt on which they are are attempting to collect payment. If a debt collector has failed to respond to validation request, then they have essentially admitted, that the debt in question is inaccurate. As such, all collection effort on the debt must cease and any derogatory listing should be permanently removed from any consumer credit reports. If the Collection Agency does respond in 30 days; while they may have your name, social security number, original balance and current balance, they may have failed to properly acqire additional paperwork regarding this debt, namely a contract signed by you authorizing the orginal debt balance. Failure of the collection agency to provide this imporatnt information, even if they sent a response within 30 days, may alloe you ti continue to pursue the debt's inaccuracy. This is not a quick process and multiple letters may have to be sent. Stay persistent
